The practice
Enforcement Legal Services is responsible for ASIC's civil, administrative and criminal enforcement activities, and provides legal advice and litigation services to ASIC's Enforcement and Compliance teams and the Commission. This includes advising on investigations, conducting civil litigation and defending ASIC's administrative decisions. Enforcement Legal Services sits within the broader Legal Services group that is responsible for the delivery of legal services across ASIC and is instrumental in driving ASIC's reputation as a modern and effective regulator. The Civil Litigation team is responsible for the conduct of ASIC's civil litigation in the High Court of Australia, the Federal Court of Australia and the State Supreme Courts. The Civil Litigation team also manages ASIC's relationship with external law firms and provides strategic guidance in those matters where ASIC has engaged an external law firm to act for it. The Administrative Law team is part of ASIC's in‑house litigation practice. The team is responsible for carriage of merits review proceedings in the Administrative Review Tribunal and judicial review proceedings in the Federal Court in respect of administrative decisions made by ASIC. The team also provides advisory services to all of ASIC concerning administrative law issues such as procedural fairness.
